Dear Sir/Madam:

Pursuant to Section 106.4.5 of the San Francisco Building Code, the Director of the Department of Building Inspection may suspend or revoke a building permit whenever the permit has been issued in error or on the basis of incorrect information supplied, or in violation of any ordinance or regulation or other provision of the Building Code.

As you know, I suspended the above-referenced permits on June 7, 2004 for a period of two (2) weeks - see Exhibit "A" attached. I am hereby continuing the suspension for the following reasons:

1. I am awaiting a decision from the Department of City Planning on my inquiry to Mr. Larry Badiner dated June 17, 2004- see ExhibIt "B" attached hereto.

2. It has come to my attention that there is a conflict in the evidence as to certain geotechnical issues that cause me to be concerned about the Department of Building Inspection's preliminary approval of the current pile design. See Exhibits "C" and "D" attached hereto.

This suspension shall remain in effect, and no work may be done at the property in question, until further notice from me.

NOTICE

Anyone who believes that my determination with respect to the site permits in question is in error or that it constitutes an abuse of discretion, may submit to me any additional documents or information relevant to this matter and/or appeal this determination to the Building Inspection Commission within 15 days from the date of this letter.
